Permission-Based Messaging
Commercial messages should be sent only when the sender has an appropriate basis for contacting the recipient, such as a valid opt-in, request for information, relevant business relationship, or other lawful authorization.
Communication Integrity
Fawkes Digital Marketing supports responsible, permission-based communication.
This policy helps protect recipients, customers, sender reputation, hosted services, and the integrity of the digital systems used to deliver email and other communications.
Consent & Responsible Messaging
Customers using Fawkes-supported services are responsible for ensuring they have the consent, legal basis, or other authorization required for the messages, newsletters, forms, campaigns, or outreach they send.
Effective date: October 14, 2025
Commercial messages should be sent only when the sender has an appropriate basis for contacting the recipient, such as a valid opt-in, request for information, relevant business relationship, or other lawful authorization.
Sender names, domains, reply-to addresses, routing information, subject lines, and other identifying information must be accurate and must not mislead recipients about the source or purpose of a communication.
Marketing communications must provide an appropriate and functional way for recipients to unsubscribe or request that future promotional messages stop.
Contact lists, consent records, suppression lists, and recipient information must be handled responsibly and protected from unauthorized access, disclosure, resale, or misuse.
Senders should use appropriate targeting, message frequency, list hygiene, and delivery practices to reduce unwanted communications, complaints, and unnecessary reputation risk.
Recipients who opt out should remain suppressed from future marketing communications unless a new and valid basis for contact is established.
Prohibited Conduct
Fawkes services may not be used to send unsolicited bulk email, phishing messages, fraudulent offers, malicious attachments, harvested-address campaigns, deceptive communications, or messages designed to evade recipient preferences, filtering systems, or reputation controls.
Unsubscribe Requirements
Customers are responsible for maintaining appropriate suppression records and preventing recipients who have opted out from being added back to future marketing campaigns without a new valid basis for contact.
Unsubscribe requests should be processed promptly and within any timeframe required by applicable law.
Sender Responsibility
Customers remain responsible for the legality, accuracy, targeting, content, frequency, and recipient selection of the communications they send.
Fawkes may provide technology and operational support, but senders must follow applicable laws, contractual requirements, industry standards, and recipient preferences.
Monitoring & Enforcement
Fawkes may review complaint activity, delivery patterns, bounce rates, sender reputation, block-list events, and other indicators when investigating suspected misuse.
We may review available sending information, complaints, and related indicators to determine whether activity appears inconsistent with this policy.
We may request documentation, proof of consent, list cleanup, sending changes, or other corrective action when concerns are identified.
Messaging capabilities or services may be restricted, suspended, or terminated when violations are confirmed or continued activity creates material risk.
Reporting Spam or Abuse
Reports are more useful when they include the sender address, sending domain, date and time received, message subject, relevant message headers when available, and a brief explanation of the concern.
Reported activity may result in additional review, outreach to the sender, corrective requirements, service restrictions, or other appropriate action.
